1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Where2 website, mobile app, and related services (collectively, the "Service").

By accessing or using Where2, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Where2. If you are under 18, you represent that you have permission from a parent or legal guardian.

2. Accounts and Security

To use certain features, you may need to create an account. You agree to:

• provide accurate and current information
• keep your login credentials confidential
• promptly update your information if it changes
• notify us if you believe your account has been compromised
• accept responsibility for activities that occur under your account

You may not:

• use another person's account without permission
• create accounts for abusive or deceptive purposes

• attempt unauthorized access to systems or accounts
• use bots, scrapers, or automation without permission

• post spam, scams, deceptive promotions, or misleading content

Where2 may provide features such as:

• smart suggestions
• translation
• video-to-itinerary conversion
• itinerary export and PowerPoint generation
• map-based itinerary visualization

These features are provided for informational and organizational purposes only. Where2 is not a travel agency, booking platform, or professional advisory service.

You are solely responsible for:

• verifying addresses, pricing, hours, and availability
• making reservations
• complying with laws, local regulations, and venue rules
• reviewing any output before sharing, exporting, or relying on it

6. Media, Video, and Uploads

If you upload media, including videos for conversion or photos for itineraries, you represent that:

• you own the content or have the right to use it
• your upload does not violate third-party rights
• your upload complies with these Terms and our Community Guidelines

You remain responsible for uploaded content and any consequences arising from it.

7. Exported Content

Where2 may allow users to export itineraries into formats such as presentations or other downloadable outputs.

You remain responsible for reviewing, using, and sharing exported content. Where2 does not guarantee formatting perfection, factual accuracy, or suitability for any commercial, educational, or legal purpose.

8. Content Moderation

We may, but are not obligated to, review, moderate, restrict, or remove User Content that violates these Terms or our Community Guidelines.

We may use automated tools and human review for moderation, abuse prevention, and safety enforcement.

9. Intellectual Property

Except for User Content, the Service and its design, branding, software, text, graphics, interfaces, logos, and functionality are owned by Where2 or its licensors and are protected by applicable intellectual property laws.

You may not copy, reverse engineer, reproduce, distribute, or create derivative works from the Service except as expressly permitted.

10. Third-Party Services

Where2 may contain links to or integrations with third-party services. We are not responsible for third-party content, products, or services. Your use of third-party services is at your own risk and may be governed by their own terms.

11. Termination

You may stop using the Service or delete your account at any time.

We may suspend, limit, or terminate your access if:

• you violate these Terms or our Community Guidelines
• we believe your conduct creates risk, harm, or legal exposure
• required by law
• necessary to protect the Service or other users

After termination, some information may remain retained as required for legal, operational, fraud-prevention, or security reasons.

WHERE2 IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that:

• the Service will always be available or error-free
• content or recommendations will be accurate or complete
• any itinerary, suggestion, translation, or exported output will meet your needs

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHERE2 AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify, defend, and hold harmless Where2 and its affiliates, officers, employees, agents, and contractors from and against claims, liabilities, damages, losses, and expenses arising out of:

• your use of the Service
• your User Content
• your violation of these Terms
• your violation of another party's rights

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules.

Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration on an individual basis, except where prohibited by law or where a claim may be brought in small claims court.

16. Changes to the Service or Terms

We may change, suspend, or discontinue parts of the Service at any time.

We may also update these Terms from time to time. If we make material changes, we will update the "Last Updated" date and post the revised Terms.

Your continued use of the Service after updated Terms are posted means you accept the revised Terms.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
